The Anti Money Launder Counter Terrorism Legislation is in force in Australia now. Legal Firms are subject to additional rules which require that we ask clients to formally identify themselves and that satisfy further regulatory requirements whenever we work for you. We’ll absorb as much of the cost of the compliance as we can, but unfortunately we’ll have to pass on some of the compliance costs to you. Those costs will be clearly disclosed in our cost agreement.

Digital Wills
Don’t make one- they may be easy to make but are expensive and difficult to prove.
A digital recording is something anyone with a smart phone can make. However, if you own property, a will must be presented as evidence in the Court. This means your phone or digital device must be examined and proved to the court. It’s complex and costly.
A will is something you draft for family and friends to assist them to administer your estate. Digital assets should be covered in your will, but leaving a digital will itself, adds another layer of complexity (therefore time and money) to the administration of your estate.

Property
An error on the Record – Property
Background: An error on the land titles office of the description of a lot and the owner of the lot. A corporation had taken possession of the land an commenced proceedings to claim adverse possession. Acting for the rightful owner we defended the action and won big.
Challenge: Proving to the Land Titles Office (LTO) that the property was wrongly described and convincing the LTO amend the record.
Outcome: Successfully defended the corporation’s land grab securing the sale of this valuable land for sale by private treaty.

The 2023 Inheritance
Background: A contentious estate case in 2018 involving multiple beneficiaries and a contested will, threatening the fabric of a family.
Challenge: Clarifying the decedent’s intentions while navigating through intricate family dynamics and legal challenges.
Outcome: Responding to 6 claims and, dividing a multimillion-dollar estate in a manner that honored the decedent’s wishes and preserved familial bonds.
Property Law
The 2022 Landmark Property Recovery Case
Background: Are aboriginal bones a defect in title. That was the question in issue when a purchaser tried to terminate a valuable contract and claim the deposit and commenced legal proceedings for breach of contract.
Challenge: The executor of the deceased’s estate successfully defended the contract and disclosures made to the purchaser prior to exchange.
Outcome: Successfully the first and final instance and defended the executor’s position which establishing a significant precedent in property law. However litigation was the last resort after early negotiations failed.
